Terms of Use

These Terms of Use ("Terms") govern your access to and use of Hytale Server Manager, its website, downloads, software, documentation, supporter features, and related services (collectively, the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be legally able to enter into these Terms in your jurisdiction. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. License and Permitted Use

Subject to these Terms, I grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for lawful personal or internal business use.

You may not:

• Copy, resell, sublicense, lease, or commercially exploit the Service except as expressly permitted
• Modify, reverse engineer, decompile, or attempt to derive source code except where prohibited by law from restricting such rights
• Circumvent access controls, supporter verification, licensing checks, or feature restrictions
• Use the Service in a way that harms the website, software, infrastructure, or other users
• Use the Service for unlawful, abusive, deceptive, or infringing activity
• Misrepresent supporter status, account ownership, or access rights
• Interfere with security features, update mechanisms, download systems, or integrations

3. Accounts and Third-Party Connections

Some features may require third-party authentication, including Patreon or other account connections. You are responsible for maintaining the accuracy of connected account information and for complying with the terms of any third-party service you choose to use.

I may rely on third-party data to determine eligibility for supporter features or access.

4. Supporter Features and Access

Certain features, add-ons, releases, or experimental tools may be limited to supporters, early access users, or verified connected accounts.

I reserve the right to:

• Modify supporter benefits at any time
• Add, remove, delay, limit, or discontinue features
• Change eligibility requirements
• Suspend or revoke access where misuse, fraud, abuse, or policy violations are suspected

Supporter access does not create a guarantee of permanent availability of any feature, release schedule, or future functionality.

5. Downloads, Updates, and Experimental Features

Software downloads, updates, and experimental features are provided as-is and may change at any time. You are responsible for testing, backups, and confirming compatibility in your own environment.

6. Intellectual Property

The Service, including software, text, graphics, branding, layout, design, and related content, is owned by me or licensed to me and is protected by applicable intellectual property laws.

These Terms do not transfer any ownership rights to you.

7. User Conduct

You agree not to:

• Use bots, scripts, scraping, or automated means to access restricted parts of the Service without permission
• Attempt unauthorized access to systems, accounts, APIs, update channels, or protected resources
• Upload, transmit, or distribute malicious code
• Use the Service to violate any law or third-party rights
• Harass, abuse, or interfere with others using the Service

8. Termination and Suspension

I may suspend, restrict, or terminate access to all or part of the Service at any time, with or without notice, for any reason, including suspected abuse, misuse, fraud, security concerns, legal risk, nonpayment, or violation of these Terms.

The Service is provided on an as-is and as-available basis without warranties of any kind. See the Disclaimer page for additional information, which is incorporated into these Terms by reference.

10. Limitation of Liability

To the fullest extent permitted by law, I shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, revenue, profits, business, goodwill, or system availability arising from or related to your use of the Service.

To the fullest extent permitted by law, my total liability for any claim arising out of or relating to the Service shall not exceed the greater of:

• the amount you paid me for the applicable Service in the 12 months before the claim, or
• USD $50

11. Indemnification

You agree to defend, indemnify, and hold harmless me, my business, affiliates, contractors, service providers, and representatives from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any law or third-party rights
• Your server activity, content, or configurations

12. Governing Law

These Terms are governed by applicable law, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the courts of competent jurisdiction, and you consent to their jurisdiction and venue.

13. Changes to These Terms

I may update these Terms from time to time. Updated versions will be posted with a revised effective date. Continued use of the Service after changes are posted means you accept the updated Terms.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy and Disclaimer, form the entire agreement between you and me regarding the Service, except where a separate written agreement applies.
